Employers who knowingly hire illegal aliens may soon face harsh penalties under DHS policy change:
In over 6,000 worksite arrests made by Immigration and Customs Enforcement (ICE) last year only a paltry 135 were employers. The rest targeted were all illegal aliens.
Today the Department of Homeland Security published a “Fact Sheet” essentially scrapping old immigration enforcement methods to focus instead on the employers who knowingly violate the law by hiring illegals--and criminal aliens. Read the rest of this entry »

In response to a question at a conference of the Anti-Defamation League, Homeland Security Secretary Janet Napolitano said she plans to work with governors to repeal the REAL ID Act, which was passed in 2005. The Act has specific identification requirements for driver’s licenses and identification cards. While states would benefit by not incurring the responsibilities and costs associated with validating citizenship or permanent resident status for holders of driver’s licenses, this move will certainly add to the immigration controversy. UPDATE: Since TPS was denied by the Bush administration, Haitian advocates are pressing President Obama to take action and grant TPS to Haitians. The Miami Herald recently reported that Secretary of State Hillary Clinton commented on the burden deported Haitians would be to Haiti at this time, and the help that remittances provide to Haitians.
Currently, there are about 30,000 Haitians facing deportation, but if TPS is granted, Haitians in the United States would receive work permits and be able to live temporarily in the United States. Read the rest of this entry »

We receive a lot of questions about Affidavits of Support, but all too often, the question that sponsors fail to ask is, “What are my financial responsibilities if I sign an Affidavit for someone?”
If you sponsor an alien to live permanently in the United States, (i.e., for a green card) by signing an Affidavit of Support you are legally obligated to supporting this individual if the alien receives certain assistance from the government. The Affidavit, which is Form I-864, is legally binding and commits you from the time the alien arrives in the United States and becomes a lawful permanent resident, until the alien is credited with 40 quarters of work or until he or she becomes a US citizen. The New York Times reported last week that the White House will take steps to tackle the controversial subject of immigration by the end of this year. the President will speak publicly in May, and serious work on legislation will begin in the summer with the expectation that legislation will be ready in the fall.
Many people see this as a natural step for the President to take since he is fulfilling a campaign promise. While the immigration system is dysfunctional to say the least, there is strong opposition to comprehensive legislation, especially in a time when many Americans have lost jobs. When Marcus came to the United States from Brazil, he was 2 years old. His father was hired by an internationally known company which any American teenager would readily recognize, and his family had the opportunity to live and work in the United States. During the years in which his father was employed in the United States, Marcus led a normal life growing up and attending school with the hopes of being a professional baseball player.
Unfortunately, all of this changed when he received a college baseball scholarship. After visiting the college and completing his application, he was notified he could not attend college or accept the scholarship without a social security number.
